TERMS OF SERVICE FOR ELECTRONIC SERVICES

profilon.pl — effective from 10 June 2026

§ 1. General provisions

1.1. These Terms of Service have been issued pursuant to Article 8(1)(1) of the Polish Act of 18 July 2002 on Providing Services by Electronic Means and set out the types, scope, and conditions of services provided electronically through the website available at profilon.pl, the conditions for entering into and terminating agreements for those services, and the complaint procedure.

1.2. The Service Provider is Piotr Nowak, address: Cystersów 8/47, 31-553 Kraków, Poland, e-mail address: kontakt@profilon.pl ("Service Provider").

1.3. The Terms of Service are made available free of charge on the Website, in a manner that allows them to be obtained, reproduced, and saved.

1.4. Before using the Services, the User should read these Terms of Service.

§ 2. Definitions

2.1. Website — the web pages available at profilon.pl together with their subpages, in the Polish and English language versions.

2.2. User — a natural person using the Services, including a consumer within the meaning of Article 22(1) of the Polish Civil Code.

2.3. Services — services provided electronically by the Service Provider through the Website, listed in point 3.1.

2.4. ProType Test — a structured self-reflection tool on working style made available on the Website, consisting of 24 questions with a five-point response scale spanning two poles.

2.5. Result — the outcome of completing the ProType Test: bands (ranges: low, mid, or high) across four working-style dimensions and, assigned on their basis, the code of one of 16 ProTypes or information that the response pattern falls between the schemes (a cross-cutting result).

2.6. Access Link — an individual link sent in the e-mail message containing the Result, including a random identifier (token) and enabling access to the extended dimension descriptions.

2.7. Newsletter — a service consisting of sending, to the e-mail address provided, information about the development of the Website and related content.

2.8. Privacy Policy — the document describing the rules of personal data processing and the use of browser storage, available on the Website.

§ 3. Types and scope of the Services

3.1. The Service Provider provides the following Services:

  • a) making the Website content available for browsing;
  • b) making the ProType Test available, together with calculating and presenting the Result;
  • c) sending, to the e-mail address provided, a message containing the Result and the Access Link to the extended dimension descriptions;
  • d) making the extended dimension descriptions available under an individual Access Link;
  • e) the Newsletter.

3.2. The Result is calculated automatically on the basis of the User's answers. After the Result is displayed, a result record is transmitted to the Service Provider's server — the answers to the questions, the values in the four dimensions, and the ProType code — marked with a random technical identifier, without the e-mail address or any other data identifying the User. The record serves the provision of the Services, statistical purposes, verification of the tool's correct operation, and its development. The details are described in the Privacy Policy.

3.3. The Test progress and the Result are also saved in the User's browser storage, which makes it possible to pause and resume the Test on the same device.

3.4. Using the Service referred to in point 3.1(c) requires providing an e-mail address and accepting the Terms of Service. Subscribing to the Newsletter requires separate, voluntary consent.

3.5. The Access Link is sent in the e-mail message containing the Result. Using it does not require creating an account. The Access Link remains active for the period of storage of the form data indicated in the Privacy Policy; after that period, access to the extended dimension descriptions expires.

3.6. All Services in the current version of the Website are provided free of charge.

3.7. The Website is intended for persons who are at least 16 years of age.

§ 4. Nature of the ProType Test and the Result

4.1. The ProType Test serves the User's self-reflection on their own working style. The Result describes a pattern of preferences across four working-style dimensions, current as at the moment of completing the Test.

4.2. The Result does not constitute an assessment of professional suitability, competence, or qualifications, is not psychological or career advice, and does not replace consultation with a specialist.

4.3. The ProType Test is not a selection instrument. It is not intended for making decisions on employment, promotion, remuneration, performance appraisal, or any other decisions concerning persons. The User undertakes not to use the Test or the Result for such purposes in relation to other persons.

4.4. The Service Provider does not guarantee that the Result will meet the User's expectations or that it will remain identical upon retaking the Test.

4.5. The Result is a starting point for the User's own reflection on their working style. Before making significant decisions on the basis of the Result, the User should consult the appropriate professionals. Any use of or reliance on the Result is at the User's own risk; this is without prejudice to point 9.3.

§ 5. Technical requirements

5.1. Using the Services requires:

  • a) a device with internet access;
  • b) an up-to-date version of a web browser with JavaScript and local data storage mechanisms (localStorage) enabled;
  • c) for the Services referred to in points 3.1(c) and (e) — an active e-mail account.

5.2. Clearing browser data, using private browsing mode, or changing the device may result in the loss of the saved Test progress or Result on the given device. The Service Provider does not restore data saved solely in the User's browser.

5.3. Where equipment or software not meeting the requirements of point 5.1 is used, the Service Provider does not guarantee the correct operation of the Website.

§ 6. Entering into and terminating the agreement

6.1. The agreement for the provision of a Service is entered into:

  • a) for browsing the content — upon opening a page of the Website;
  • b) for the ProType Test — upon starting the Test;
  • c) for sending the message containing the Result — upon submitting the form with the Terms of Service accepted;
  • d) for the Newsletter — upon giving consent (ticking the separate box in the form).

6.2. The agreement is terminated:

  • a) for browsing the content and the Test — upon leaving the Website;
  • b) for the Newsletter — upon unsubscribing (clicking the unsubscribe link in any message or sending a message to kontakt@profilon.pl);
  • c) for the remaining Services — upon submitting a request to discontinue the Service to kontakt@profilon.pl.

6.3. A User who is a consumer may withdraw from the agreement within 14 days of entering into it, without giving any reason, by sending a statement to kontakt@profilon.pl.

6.4. The Service Provider may discontinue individual Services or change their scope, informing about this on the Website, and Newsletter subscribers — also by e-mail.

§ 7. Rules for using the Website

7.1. The User is prohibited from supplying unlawful content and from taking actions that could disrupt the operation of the Website or of the IT systems used to provide the Services.

7.2. It is prohibited to use the Website in an automated manner, including bulk downloading of content and automated form submissions, as well as to use the Services to send unsolicited commercial communications.

§ 8. Complaints

8.1. Complaints concerning the Services may be submitted by e-mail to kontakt@profilon.pl. A complaint should include a description of the objections, the substance of the request, and contact details enabling a response.

8.2. The Service Provider examines the complaint and responds to the e-mail address from which it was sent within 14 days of its receipt.

8.3. If it is not possible to examine the complaint within this period, the Service Provider will, within this period, inform about the reason for the delay and the expected response date.

§ 9. Liability

9.1. The Service Provider reserves the right to technical interruptions related to the maintenance or development of the Website.

9.2. The Service Provider is not liable for interruptions in the provision of the Services resulting from failures of IT systems beyond its control, nor for the consequences of the User's failure to meet the technical requirements set out in § 5.

9.3. The provisions of these Terms of Service do not exclude or limit consumer rights arising from mandatory provisions of law.

§ 10. Intellectual property

10.1. The content of the Website, including the Test questions, the descriptions of the dimensions and ProTypes, the graphic layout, and the designations, is protected by copyright and belongs to the Service Provider or to entities with which the Service Provider has concluded appropriate agreements.

10.2. The User may use the content of the Website solely within the scope of their own personal use. Copying, distributing, or making the content publicly available to a wider extent requires the Service Provider's prior consent.

§ 11. Personal data

11.1. The controller of the Users' personal data is the Service Provider. The rules of personal data processing and of the use of browser storage and cookies are described in the Privacy Policy available on the Website.

§ 12. Amendments to the Terms of Service

12.1. The Service Provider may amend the Terms of Service for important reasons, in particular in the event of changes in the law, in the scope of the Services, or in the manner of their provision.

12.2. The Service Provider informs about an amendment to the Terms of Service by publishing the new version on the Website, and Newsletter subscribers — also by e-mail, at least 14 days before the amendments take effect.

12.3. A User who does not accept the amendments may stop using the Services, including unsubscribing from the Newsletter, before the date the amendments take effect.

§ 13. Final provisions

13.1. In matters not regulated by these Terms of Service, the provisions of Polish law apply, in particular the Civil Code, the Act on Providing Services by Electronic Means, and the Act on Consumer Rights.

13.2. A consumer may use out-of-court means of handling complaints and pursuing claims, including the assistance of a municipal or district consumer ombudsman and proceedings before the competent regional inspector of the Trade Inspection.

13.3. The Terms of Service are made available in the Polish and English language versions. In the event of any discrepancy between the versions, the Polish version prevails.

13.4. These Terms of Service are effective from 10 June 2026.
